HIPAA Notice of Privacy Practices

Effective date: January 1, 2020. This notice describes how Dome Home Care may use and disclose your protected health information (PHI), and your rights regarding that information. Please read it carefully.

1. How We May Use and Disclose Your Information

Treatment, Payment, and Health Care Operations

We use and disclose your PHI to provide your prescribed equipment and supplies, coordinate with your physicians and care team, bill your insurance or Medicare, and conduct quality assessment and improvement activities. We may share information with contractors and business associates who help us deliver your equipment, process billing, or service your devices — all of whom are required to safeguard your information appropriately.

Other Permitted and Required Disclosures

• Persons involved in your care: Family members or others involved in your care or payment may be notified of your location and general condition, unless you object.
• Health oversight and public health: We may disclose information for regulatory compliance, disease control, or to report adverse events to the FDA.
• Health or safety emergencies: To prevent a serious and imminent threat to your health or safety, or that of others.
• Abuse, neglect, or domestic violence: Reporting to government agencies as required by law.
• Legal and law enforcement requirements: Court orders, subpoenas, or other legal processes.
• Workers' compensation, research, and de-identified data: As permitted by applicable law.

Uses That Require Your Written Authorization

Marketing communications and any sale of your PHI require your written authorization. We will never sell your health information.

2. Your Rights

• Request access to and receive a copy of your health records.
• Request that we amend your health information if you believe it is incorrect or incomplete.
• Request confidential communications by an alternate method or location.
• Request restrictions on certain uses or disclosures of your information.
• Receive an accounting of certain disclosures we have made.
• Receive notification if a breach of your unsecured PHI occurs.
• Receive a paper copy of this notice at any time, even if you agreed to receive it electronically.

3. Our Responsibilities

We are required by law to maintain the privacy of your PHI, provide you with this notice describing our legal duties and privacy practices, and follow the terms of the notice currently in effect. We will abide by any state law that provides greater privacy protection than HIPAA.

4. Changes to This Notice

We reserve the right to change this notice. Any revised notice will apply to PHI we already have as well as PHI we receive in the future, and will be made available on this page and at our office.

5. How to File a Complaint

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
